Welcome to MassageHome. Below are all the terms and conditions which you can accept after booking the massage services. You should go through these agreements carefully before making a service request.
Definitions.
- Company: MassageHome providing mobile massage therapy services at your place.
- Client: Individual or entity who books services from the company-MassageHome.
- Therapist: The licensed therapists who work for MassageHome are engaged by a contract.
- Service: The types of services provided by MassageHome therapy for the clients, be it at their homes, hotels, offices, hospitals, events or senior residences.
Appeals.
- Only individuals who are eighteen (18) years and above will be allowed to make bookings. Minors may receive services with written consent from a parent or legal guardian (like a message for children or infants)
Booking and Amendments to Appointments.
- The management has put in place an acceptance procedure via the companies’ website.
- The scheduled appointments must be made at least 2 hours to the intended relaxation appointment.
- Cancellation of appointments or rescheduling of appointments should be done at least 2 hours both before taking appointments and for the appointment itself.
- At times, however, MassageHome may unreasonably refuse service because of a number of factors in the environment like services may be dangerous to health because of the condition of the client or the client’s premises.
Cash Regulations.
- The clients will be required to pay for the service at the stage of booking. Payment may either be made at the time of booking a service or at the time the service is rendered.
We use pay-pal, credit/debit card and other payment methods as mentioned on the “website”.
- There are no hidden steps and the prices provided are all exclusive taxes.
- There are no obligatory TIPS but many customers leave them as a sign of appreciating a job well done.
Health and Safety
- It is necessary for the client to disclose any medical history and restrictions or allergies if any to the therapist before the service begins.
- The therapists have the right to refuse or end any of the sessions, even in the middle of a session, if it is deemed that massage is not advisable for the client’s health condition.
- MassageHome adheres to the rules of hygiene and safety. Our therapists will change their outfits and use properly cleaned items for every session.
Professional Conduct
- All the services performed on the clients by the MassageHome therapists are purely professional therapeutic. All the above measures to counter inappropriate conducts will, boulders or blocks the time-billing policy of MassageHome without compensation for the services rendered and closer may order court proceedings if it is required to do so.
- Disclose any physical or other conditions that may affect the care you receive from the massage therapist.
- Acknowledge that despite adherence to public health sanitary instructions, there may still be risks of virus transmission, including COVID-19.
- Agree to hold MassageHome, its owners, Therapists, and massage therapists harmless for any damage or loss resulting from the care provided.
- Waive any past, present, or future claims arising from the care received.
- Release MassageHome, its owners, Therapists, certified massage therapists, and affiliated third parties from any liability related to the care provided.
- Understand that MassageHome, its owners, and Therapists are not legally, morally, or financially responsible for the behavior or comments of massage therapists.
- Agree to indemnify and hold MassageHome, its owners, and Therapists harmless from any demands, losses, liabilities, claims, or expenses (including attorney’s fees) from third parties arising out of your use of the website or its services.
Liability
- MassageHome, as well as its therapists, takes no responsibility in relation to those injuries and/or conditions which existed prior and which have been worsened in the course of a massage session and thereafter. Clients take all the responsibilities for their own health any way.
- MassageHome is not responsible for restoring such property to the client if it was lost or damaged during the service, besides gross negligence on the part of the therapist.
Service Areas
- The services provided by MassageHome extend to the boundaries of the province of Quebec.
Privacy
- Any information that individual users of MassageHome furnish will be anonymous and such information will be used only for the purpose of rendering services. Our policy is not to share, sell or allow any client information to be used without client consent except as the law may demand.
Changes to Terms
- MassageHome reserves the right to implement changes or even alterations to these terms and conditions without restriction or time limits. Clients should be informed of the most important changes, and using services after the change is made is construed as agreement with such amendments.
Termination of Services
- MassageHome at this discretion may cancel any contract or cease to render any service. In particular, clients may also terminate their agreement with us which should be desiderated before the appointment.
- Clients are also required to display professional conduct and civility when interacting with any of the massage therapist.
- It is mandatory to avoid any discussions with such comments as sexual, offensive or in any other way, disrespecting the Therapists any such conversation will be terminated instantly.
- Likewise, participating in any sexual relations, use of sexual remarks or any form of sexual misconduct towards the therapist will not be tolerated.
- It is up to the massage therapists to be able to report someone or an incident that they consider as unsafe for their safety.
- When the report is made, the adequate measures for protection of the therapist will be provided which may involve legal action, termination of service and future restrictions to book an appointment.
- Here we realize our key goal – to create comfortable, appropriate and professional working conditions for clients and specialists.
Dispute Resolution
- Formerly it found in those instances, arising from the execution of MassageHome services these unresolved conflicts are settled by the Negotiation. When this is not effective, the parties will resolve the dispute in accordance with the country’s dominant legal system provisions, in this case, Quebec law.
- Any and all actions or matters relating to the criminal and civil actions must be submitted and entertained within the municipality of Quebec’s courts.
Governing Law
These terms and conditions are subject to the laws of Quebec and the laws of Canada. They also accept that any case filed by a client in Quebec is subject to the exclusive jurisdiction of the courts based in Quebec, Canada.
Intellectual Property
These pages and any content, logos, designs and material owned by the MassageHome website or advertising materials and any other related sites are owned by MassageHome. Clients and other third parties shall not use, copy or disseminate the said materials without prior written approval from MassageHome.
Unforeseen Events
The company undertakes no responsibility for any action or failure of the company to fulfill any obligations arising from these terms which is caused by factors that the company cannot reasonably control such as disasters, industrial action or other unforeseeable events.
Acceptance of Terms
Clients agree to all of the provided terms and conditions by making a booking and using services provided by MassageHome.
